These Terms of Service ("Terms") govern your access to and use of Purplenimo ("Purplenimo," "we," "us," or "our"), available at purplenimo.com, including our hashtag generator, caption generator, Instagram photo/reel downloader, AI music generator, AI lyrics generator, and song/vocal splitter (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility and Account Registration

• You must be at least 13 years old (or the minimum age of consent in your jurisdiction) to use the Services.
• Accounts are created and accessed via Google Sign-In. We do not create or store passwords; your login credentials are managed entirely by Google.
• You are responsible for maintaining the security of your Google account and for all activity that occurs under your Purplenimo account.

2. Description of Services

Purplenimo provides the following tools:

• Hashtag Generator — generates hashtags from user-entered keywords or uploaded images, using either AI or an Instagram hashtag database.
• Caption Generator — generates captions using AI, based on user-entered keywords/phrases or an uploaded image.
• Instagram Photo/Reel Downloader — allows users to submit a public Instagram link to download the associated photo or reel.
• AI Music Generator — allows users to generate original music from their own prompt or a Purplenimo-provided prompt, including AI-generated cover art.
• AI Lyrics Generator — allows users to generate lyrics from their own input, mood/genre selections, or editable pre-built prompts.
• Song Splitter — separates vocals and instrumentals from a user-submitted song.

We may add, modify, or remove features at any time without prior notice.

3. User Content and Responsibilities

You are solely responsible for any content, keywords, images, prompts, links, or audio files you submit to the Services ("User Input").

By submitting User Input, you represent and warrant that:

• You own it or have all necessary rights, licenses, and permissions to submit and use it;
• Your use of the Services, including any Instagram content you link to for download, does not infringe any third party's copyright, trademark, privacy, publicity, or other rights;
• You will not use the Instagram Photo/Reel Downloader to download, redistribute, or commercially exploit content you do not own or have permission to use.

Purplenimo is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. The download tool is provided for accessing publicly available content you link to, and it is your responsibility to ensure your use of any downloaded content complies with the applicable platform's terms of service and applicable copyright law.

4. AI-Generated Content: Ownership and Licensing

4.1 Paid Users

For users on a paid plan, songs, cover art, and lyrics generated through the Services are provided on a 100% royalty-free basis, and may be used for commercial purposes, including but not limited to reselling, modifying, streaming (e.g., on Spotify), publishing on YouTube or social media, and monetization, without payment of additional royalties or licensing fees to Purplenimo.

4.2 Free Users

For users on a free plan, generated songs, cover art, and lyrics are provided for personal, non-commercial use only, unless and until the user upgrades to a paid plan. Commercial use, resale, redistribution, or monetization of content generated under a free plan is not permitted.

4.3 General

• AI-generated content may not be entirely unique; similar prompts by different users may produce similar or identical outputs. Purplenimo does not guarantee exclusivity of any generated content.
• You are responsible for ensuring your use of AI-generated content complies with the policies of any third-party platform (e.g., streaming services, social media platforms) where you publish it.
• Purplenimo reserves the right to use anonymized or aggregated data about generated content to improve the Services.

5. Payments, Subscriptions, and Refunds

• Payments are processed securely through PayPal. We do not store your payment card or bank details.
• Paid features (including commercial licensing of AI-generated songs and lyrics) require an active paid plan.
• Refund Policy: You may request a refund within 15 days of your purchase by contacting [email protected]. Refunds outside this window are granted at our sole discretion.

6. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
• Use the Instagram downloader to infringe the copyright or other rights of content creators;
• Attempt to reverse-engineer, decompile, or interfere with the Services or underlying technology;
• Use automated means (bots, scrapers) to access the Services beyond normal use;
• Impersonate any person or entity or misrepresent your identity;
• Upload content that is unlawful, defamatory, obscene, or infringes any third party's rights;
• Resell or sublicense access to the Services without our prior written consent.

7. Intellectual Property

Except for User Input and the AI-generated content licensed to you under Section 4, all rights, title, and interest in the Services — including our software, design, branding, and underlying technology — remain the exclusive property of Purplenimo and its licensors.

8. Third-Party Services

The Services rely on and integrate with third-party providers, including Google (Sign-In and Analytics), PayPal (payments), and AI technology providers used to generate hashtags, captions, lyrics, music, and cover art. We are not responsible for the availability, accuracy, or practices of these third-party services, which are governed by their own terms and privacy policies.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated output.

We do not guarantee that the Services will be uninterrupted, error-free, or that downloaded, generated, or split content will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, Purplenimo and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Services, even if advised of the possibility of such damages.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to Purplenimo or other users. You may stop using the Services and disconnect your Google account at any time.

12. Changes to These Terms

We may revise these Terms from time to time. We will post the updated Terms on this page with a new "Last Updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
